Ņemot vērā Satversmes tiesas šā gada 5. marta spriedumu kapsētu apsaimniekošana jomā, Rīgas domes Mājokļu un vides departamenta Kapsētu pārvalde šobrīd vairs nepiemēro maksu par kapa vietas piešķiršanu un personām bez atlīdzības piešķir apbedījumam nepieciešamo vietu skaitu.
2019. gada 5. martā Satversmes tiesa pieņēma spriedumu lietā Nr. 2018-08-03, par antikonstitucionālām un neatbilstošām Latvijas Republikas Satversmes 1. pantam atzīstot Jūrmalas pilsētas pašvaldības Saistošo noteikumu Nr. 27 normas, kas noteica ikgadēju nomas maksu par kapavietu. Vienlaikus Satversmes tiesa spriedumā akcentējusi, ka citu Latvijas pašvaldību noteiktās maksas par kapavietas piešķiršanu kā maksu par pakalpojumu, ir pretrunā ar noteikumu, ka arī pēc cilvēka nāves pret viņa ķermeni ir jāizturas ar cieņu. Tādējādi Satversmes tiesa secināja, ka kapavietas piešķiršana nav pakalpojums, par kuru pašvaldības dome būtu tiesīga noteikt samaksu.
Rīgas pašvaldība 2019. gada 8. martā saņēma Vides aizsardzības un reģionālās attīstības ministrijas (VARAM) vēstuli ar lūgumu pārskatīt esošo saistošo noteikumu atbilstību spriedumā noteiktajam un gadījumā, ja pašvaldības normatīvajos aktos pastāv šādas satura tiesību normas, tās nepiemērot arī pirms grozījumu veikšana saistošajos noteikumos.
“Ņemot vērā Satversmes tiesas spriedumu un VARAM aicinājumu, maksa par kapa vietas ierādīšanu Rīgas pilsētas kapsētās netiek piemērota,” uzsvēra Kapsētu pārvaldes priekšnieka p.i. Ginta Zēla.
Zēla norādīja, ka vienlaikus tiek veiktas darbības nepieciešamo grozījumu sagatavošanai un veikšanai Rīgas domes normatīvajos aktos – Rīgas domes 28.04.2015. saistošajos noteikumos Nr.145 „Rīgas pilsētas pašvaldības kapsētu darbības un uzturēšanas saistošie noteikumi” un 19.03.2013. Rīgas domes lēmumā Nr.5964 „Par Rīgas domes Mājokļu un vides departamenta maksas pakalpojumiem”. “Rīgas pilsētas pašvaldības kapsētās tiek veikti vairāk kā 7000 apbedījumi gadā un kapsētas teritorijas ik gadu tiek paplašinātas teju par 2 hektāriem. Ja mazākās pašvaldības kapsētām var atvēlēt plašas teritorijas, tad Rīgā pieejamā teritorija ir ierobežota. Maksa par kapavietas ierādīšanu ne tikai nodrošināja kapsētu uzturēšanai nepieciešamos līdzekļus, bet sniedza iespēju iedzīvotājiem izvēlēties kapavietas lielumu un veidot plašāku ģimenes kapavietu ar nodomu paredzēt atdusas vietas vairākiem ģimenes locekļiem vienkopus. Šobrīd nav skaidrības, pēc kādiem kritērijiem pašvaldība varētu diferencēt bezmaksas kapavietas izmēru,” būtiskākos jautājumus ieskicē Zēla.
Ņemot vērā, ka spriedums būtiski izmaina līdzšinējo kārtību kādā personām tika organizēta kapavietu piešķiršana, Mājokļu un vides departaments ir nosūtījis aicinājumu VARAM iespējami īsākā laikā organizēt tikšanos, lai vienotos par vadlīnijām normatīvo aktu izstrādē.
Satversmes tiesas spriedumā norādīts, ka apstrīdēto normu atcelšanai šajā gadījumā nevar noteikt atpakaļvērstu spēku un apstrīdētās normas uzskatāmas par spēkā neesošām tikai no minētā sprieduma publicēšanas dienas.
Jāņem vērā, ka organizējot aizgājēja apbedīšanu, tā pat kā līdz šim jārēķinās ar citiem apbedīšanai nepieciešamajiem maksas pakalpojumiem, piem. kapa bedres rakšana, kapličas zvana zvanīšana, kapavietas sagatavošana un kopiņas veidošana u.c.
